Legal question / Release Form

Hi gang,

Last weekend my band was supposed to reunite after 15 years to play a benefit concert in Whitehall.  The band was forced to cancel due to unfortunate circumstances, but I decided to make the best of it and wound up shooting 902 pictures over an 8-hour period.

The pictures came out much better than I had anticipated, and although I am donating most of the shots to the bands (it was a benefit concert after all), I have had a few people ask me about purchasing larger versions.  Do I have to get a release from each of the band members to put online and sell, or can I just sell them due to the fact that it was a public event?

Most of the band members are good friends of mine, and probably wouldn't mind if I sold the pictures, but I want to make sure all of my bases are covered.

Any help or resources are much appreciated.

Public Venue?
I don't believe you do.
I would send them an email to check because some big bands have contracts with photo companies.

Hi Anthony,

Thanks for the response.  These are local cover bands, and I can pretty much guarantee they do not have any contracts.  However, I had planned on asking out of courtesy.

I guess my big question was the whole public venue deal.  Does that go for taking someone's picture on the street as well?  When is a release required?
